Arbitrator Upholds Discipline on Three Contract Advisors

CARD SUSPENDS CONTRACT ADVISOR MARTIN MAGID’S CERTIFICATION

Based on information presented to the National Football League Players Association (“NFLPA”), a determination was made that NFLPA Certified Contract Advisor Martin Magid failed to meet his professional obligations to his former client, Elvis Dumervil, thereby violating the NFLPA Regulations Governing Contract Advisors. When questioned by the NFLPA about his actions surrounding the termination of Mr. Dumervil’s contract by the Denver Broncos, Magid gave several statements under oath that, along with other evidence discovered by an NFLPA investigation into the matter, provided a basis to issue a disciplinary complaint. On October 22, 2013, after reviewing the evidence, the NFLPA Committee on Agent Regulation and Discipline (“CARD”) imposed discipline of a six (6) month suspension of Magid’s certification and a $25,000 fine.

On October 23, 2013, Magid appealed the CARD decision, and a hearing was set before Arbitrator Roger Kaplan. In a decision issued by Kaplan on June 16, 2014, the arbitrator found that Magid’s insufficient knowledge of the CBA and negligence violated NFLPA Regulations Governing Contract Advisors, and he upheld the six (6) month suspension; he revoked the fine. Therefore, Magid is suspended for a period lasting six (6) months from the date of the decision.

CARD FINES CONTRACT ADVISORS JOSHUA HARE AND MALIK SHAREEF

The NFLPA Committee on Agent Regulation and Discipline (“CARD”) fined NFLPA Contract Advisors Joshua Hare and Malik Shareef $25,000 each for entering into representation agreements with players that are prohibited by the NFLPA Regulations Governing Contract Advisors (“Regulations”). In addition, Hare and Shareef failed to provide the NFLPA with copies of the prohibited representation agreements as well as copies of other agreements they entered into with players. Hare and Shareef appealed the discipline pursuant to the Regulations and a hearing was held before Arbitrator Roger Kaplan. The Arbitrator reduced the discipline to a $12,500 fine assessed on each Contract Advisor.
